These Terms of Service ("Terms") govern your use of the Bastuhus Sauna House website (bastuhus.ca), our booking platform, and our facility at 536 Eastern Ave, Toronto, Ontario ("Bastuhus," "we," "us," "our"). By using our website, creating an account, booking a session, or visiting our facility, you agree to these Terms.
Bastuhus is a Nordic sauna and cold plunge house offering self-guided and guided contrast therapy sessions, including sauna use, cold plunge use, and related wellness experiences. Sessions are booked through our online booking system, operated in partnership with Mariana Tek (Xplor Technologies).
Bastuhus facilities are available to guests 18 years of age and older. Valid photo ID may be requested to confirm eligibility.
Contrast therapy — alternating heat and cold — is a wellness practice, not a medical treatment. It involves real physiological stress and carries inherent risks, including but not limited to fainting, dehydration, changes in blood pressure, and cardiovascular strain.
By using our facility, you confirm that:
Bastuhus staff are not medical professionals and do not provide medical advice, diagnosis, or treatment.
Assumption of Risk. You acknowledge that use of the sauna, cold plunge, and related facilities at Bastuhus Sauna House involves inherent risks, including but not limited to burns, heat exhaustion, heat stroke, fainting or loss of consciousness, cardiac or circulatory stress, hypothermia or cold shock, slips and falls on wet surfaces, and aggravation of pre-existing medical conditions. You voluntarily and knowingly assume all such risks, whether known or unknown, arising from your use of Bastuhus's facilities, whether or not caused by negligence.
Release of Claims. In consideration for being permitted to use Bastuhus's facilities, you, on behalf of yourself and your heirs, executors, and assigns, hereby release, waive, discharge, and covenant not to sue Bastuhus Sauna House, its owners, officers, employees, contractors, and agents (collectively, the "Released Parties") from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by you while using Bastuhus's facilities, or while on the premises, whether caused by the negligence of the Released Parties or otherwise, except to the extent caused by the gross negligence or willful misconduct of the Released Parties.
Indemnification. You agree to indemnify and hold harmless the Released Parties from any loss, liability, damage, or cost, including reasonable legal fees, that any of the Released Parties may incur due to your presence at or use of Bastuhus's facilities, whether caused by your negligence or otherwise.
Medical Fitness. You represent that you are physically fit and have no medical condition that would prevent your safe participation, or that you have consulted a physician and been cleared to do so. You understand the health guidance in Section 3 and agree it is your sole responsibility to comply with it.
Acknowledgment. You acknowledge that you have read this waiver, understand its terms, understand that you are giving up substantial legal rights, including the right to sue, and have signed it voluntarily and without any inducement.
If any portion of this waiver is found unenforceable by a court of competent jurisdiction, the remainder shall remain in full force and effect, and the unenforceable portion shall be modified to the minimum extent necessary to make it enforceable.
Sessions are booked and paid for through our booking platform, Mariana Tek, operated by Xplor Technologies ("Payment Processor"). Processing of payments is subject to the terms, conditions, and privacy policies of the Payment Processor in addition to these Terms. Bastuhus is not responsible for errors made by the Payment Processor.

Bastuhus is not responsible for lost, stolen, or damaged personal belongings, including items left in changerooms or lockers. Please keep valuables with you or leave them at home.
By opting in, you agree to receive recurring automated text messages from Bastuhus Sauna House ("we," "us," "our") at the mobile number you provided. Messages may include appointment reminders, booking confirmations, account alerts, and promotional offers. Consent to receive these messages is not a condition of any purchase.
You may receive up to 4 messages per month. Message frequency may vary depending on your activity and interactions with us.
Message and data rates may apply. Charges are billed by and payable to your mobile service provider. Please contact your wireless carrier for details about your messaging plan.
You can unsubscribe from the SMS service at any time by replying STOP to any message we send you. After you send STOP, you will receive a one-time confirmation message, and no further messages will be sent. If you want to rejoin, you can sign up again using the original opt-in method or reply START. For help or more information at any time, reply HELP to any of our messages. Carriers are not liable for any delayed or undelivered messages.

To the fullest extent permitted by law, Bastuhus Sauna House is not liable for any indirect, incidental, or consequential damages arising from your use of our website, booking system, or facility.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
If a dispute arises between you and Bastuhus, we encourage you to contact us first so we can try to resolve it informally. If a resolution can't be reached informally, both parties agree to attempt mediation before pursuing litigation. Nothing in this section prevents either party from seeking urgent injunctive relief where appropriate. Any legal proceedings will take place in the courts of Ontario.
Severability. If any part of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement. These Terms, together with our Privacy Policy and any policies referenced within them, make up the entire agreement between you and Bastuhus regarding your use of our services, and supersede any prior agreements.
Force Majeure. Bastuhus is not liable for any failure or delay in performance resulting from events beyond our reasonable control, including natural disasters, government action, utility or equipment failure, or other circumstances that make it impracticable to operate the facility as scheduled.
No Waiver. Our failure to enforce any part of these Terms at any time does not waive our right to enforce it later.
We may update these Terms from time to time. The "Effective date" at the top of this page reflects the most recent revision.
